“Bush’s Torture Ticking Time Bomb: Sins of Commission” de James Bovard

The MCA [Military Commissions Act] awarded Bush the power to label anyone on earth an enemy combatant and lock then up in perpetuity, nullifying the habeas corpus provision of the Constitution and “turning back the clock 800 years,” as Sen. Arlen Specter (R-PA) said. While only foreigners can be tried before military tribunals, Americans accused of being enemy combatants can be detained indefinitely without charges and without appeal. Even though the Pentagon has effectively admitted that many of the people detained at Guantanamo were wrongfully seized and held, the MCA presumes that the president of the United States is both omniscient and always fair.

Instead of clear standards established by the legislature, the president decrees what methods of brutalizing detainees are allowed, regardless of the Geneva Convention or the U.S. Anti-Torture Act. As Yale law professor Jack Balkin notes, “The President has created a new regime in which he is a law unto himself on issues of prisoner interrogations. He decides whether he has violated the laws, and he decides whether to prosecute the people he in turn urges to break the law.” White House press spokesman Tony Snow agreed that the law made Bush the “final arbiter on torture.”

É mesmo pena que um tipo simples, cristão, do Texas (um Estado que tem na sua constituição estadual que pode sair da União quando bem lhe apetecer, e que as pessoas andam de arma na rua…) tenha sido convencido a fazer coisas complicadas por intelectuais tortuosos e se veja a si mesmo a fazer estas coisas… Digo-o com pena. Tivesse concentrado a sua capacidade de empatia com a classe média em grandes reformas internas e teria conseguido grandes coisas. A politica externa dá sempre cabo das melhores oportunidades. Foi tentado pelo uso do poder e não resistiu. É o problema do anel. “Frodo failed. Bush has the Ring.”

  3. CN, concordo com voce. Bush tinha tudo para sair do governo como o heroi triunfante da nacao, o protetor dos americanos. Pecou por burrice. Eu ainda gosto dele, antes um republicano no poder do que um democrata idiota. Mas nem por isso acho que ele nao poderia ter feito melhor….
